Terms of Service

1. Service Description

PT AI Platform ("the Service") is an AI-powered assistant platform for personal trainers. The Service provides automated client communication via WhatsApp, AI-generated training programs, appointment scheduling, and billing management. By using the Service, you agree to these Terms of Service.

2. Account Registration

To use the Service, you must:

  • Be at least 18 years old.
  • Provide accurate and complete registration information.
  • Keep your account credentials secure and not share them with others.
  • Notify us immediately of any unauthorized use of your account.

You are responsible for all activity that occurs under your account.

3. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable regulations.
  • Upload or transmit harmful content, malware, or spam through the platform.
  • Attempt to access other users' accounts or data without authorization.
  • Use the AI agent to provide medical diagnoses, prescriptions, or other regulated health advice.
  • Resell, sublicense, or redistribute the Service without written consent.

4. Payment Terms

PT Subscription Model

Personal trainers who do not charge clients through the platform pay a monthly subscription fee of €30/month. This subscription grants full access to all platform features.

Client Billing Model

Personal trainers who charge clients through the platform set their own monthly client rate. The platform retains 30% of client payments as a service fee, and 70% is paid out to the PT via Stripe Connect.

Money-Back Guarantee

We offer a 60-day money-back guarantee. If you are not satisfied with the Service within the first 60 days of your subscription, contact us for a full refund.

Cancellation

You may cancel your subscription at any time. Upon cancellation, you retain access until the end of your current billing period. All payments are processed securely through Stripe.

5. AI Disclaimer

The AI-powered features of the Service, including training program generation and automated client communication, are provided as tools to assist personal trainers. The AI does not provide medical advice, diagnoses, or treatment recommendations.

Personal trainers remain fully responsible for the accuracy and appropriateness of all training programs, health advice, and recommendations delivered to their clients, whether generated by AI or otherwise.

Clients should consult qualified healthcare professionals before starting any new exercise program, particularly if they have pre-existing medical conditions.

6. Intellectual Property

The Service, including its design, code, and branding, is owned by PT AI Platform. Training programs generated by the AI are owned by the personal trainer who created them through the platform.

You retain ownership of all client data and content you upload to the platform.

7. Limitation of Liability

To the maximum extent permitted by law, PT AI Platform shall not be liable for:

  • Indirect, incidental, or consequential damages arising from your use of the Service.
  • Loss of data, revenue, or profits resulting from service interruptions or technical issues.
  • Injuries or health issues resulting from training programs generated or delivered through the platform.
  • Actions taken by the AI agent that were not reviewed or approved by the personal trainer.

Our total liability shall not exceed the amount you paid for the Service in the 12 months preceding the claim.

8. Termination

We reserve the right to suspend or terminate your account if you violate these Terms. Upon termination:

  • Your access to the Service will be revoked.
  • Your data will be retained for 30 days, during which you may request an export.
  • After 30 days, your data will be permanently deleted in accordance with our Privacy Policy.

9. Governing Law

These Terms are governed by the laws of the Netherlands and the European Union. Any disputes arising from these Terms shall be resolved in the courts of the Netherlands.

10. Changes to These Terms

We may update these Terms from time to time. We will notify registered users of significant changes via email. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
